FAQs - Frequently Asked Questions

  • The holder of a patent possesses the authority to determine which individuals or entities are permitted to utilize the patented creation during its period of protection. Essentially, a patent affords protection that prevents the invention from being produced, employed, dispensed, imported, or traded commercially by any party without the express permission of the patent holder.

  • A patent can be awarded for innovations in various fields of technology, ranging from common household utensils to cutting-edge nanotech chips. An innovation can take the form of a product, like a chemical compound, or a process, such as a procedure for producing a particular chemical compound. In reality, numerous products are composed of multiple inventions, with a laptop computer serving as a prime example of hundreds of inventions working in conjunction with one another.

  • 1. For an invention to be eligible for patenting, it must possess an element of novelty, which means it must have a new characteristic that is not present in the existing knowledge of its technical field, known as "prior art."

    2. The invention should involve an "inventive step" or be non-obvious, meaning it should not be easily deduced by a person possessing ordinary expertise in the relevant technical domain.

    3. The invention must be industrially applicable, implying that it should be capable of being used for industrial or business purposes beyond being a mere theoretical concept or idea.

    4. The subject matter of the invention must be acknowledged as "patentable" under the law. Scientific theories, aesthetic creations, mathematical methods, plant or animal varieties, discoveries of natural substances, commercial methods, methods for medical treatment (as opposed to medical products), or computer programs are typically not eligible for patent protection in many countries.

    5. The invention must be disclosed in an application in a clear and comprehensive manner to enable a person with an average level of proficiency in the relevant technical field to replicate it.

  • While it is possible for applicants to prepare and file their patent applications without the aid of a patent attorney, the intricate nature of patent documents and the legal expertise necessary for claim drafting make it highly recommended to seek legal counsel from a qualified patent attorney or agent.

Moreover, in several countries, the law mandates that applicants, whose primary place of business or ordinary residence is situated outside the country, be represented by an attorney or agent who is qualified to practice in that particular country. Information regarding qualified attorneys and agents can be obtained directly from national and regional intellectual property (IP) offices.

  • Certain nations may offer patent protection that surpasses the standard 20-year period, or alternatively, grant a Supplementary Protection Certificate (SPC) in extremely restricted scenarios. The purpose of these extensions is to offset the time consumed by the administrative approval process before products can be launched in the market. This delay can mean that the patent owner may not be able to capitalize on their patent rights for a substantial length of time following the patent's issuance.
